2. GOVERNING DOCUMENTS & ACKNOWLEDGMENT
These Auction Terms & Conditions, together with the Auction Purchase Agreement and any auction-specific addenda, constitute the entire agreement among the Seller, Auctioneer, and Bidder. The executed Purchase Agreement shall control and supersede all advertising, summaries, listings, brochures, or oral statements. By registering, bidding, or submitting an offer, Bidder acknowledges that they have read, understand, and agree to be bound by all Auction Terms & Conditions without exception.
3. BUYER’S PREMIUM
A ten percent (10%) Buyer’s Premium shall be added to the high bid to determine the final contract purchase price.

Buyer’s Premium (10%): $20,000
Total Contract Price: $220,000
The Buyer’s Premium is earned upon acceptance of the bid and is non-negotiable.
4. PRE-AUCTION OFFERS
Seller reserves the right to consider, negotiate, accept, or reject pre-auction offers at Seller’s sole discretion.
All pre-auction offers must:
- Be submitted prior to the auction close
- Comply with all auction terms
- Include the 10% Buyer’s Premium
- Be non-contingent and on the Auction Purchase Agreement
If a pre-auction offer is accepted:
- The auction will be cancelled
- Any remaining open houses or previews will be cancelled
- No further bids will be accepted

5. BIDDER REGISTRATION & BIDDING AUTHORITY
All bidders must register online at AuctionNow.bid and be approved before bidding.
Bidders represent and warrant that:
- They are at least 18 years of age
- They are legally capable of entering into binding contracts

Bidders are responsible for all bids placed under their account.
Bids are final and binding and may not be retracted, modified, or rescinded for any reason.
6. BIDDING FORMAT & EXTENDED BIDDING
The auction is conducted as a timed online auction. Extended bidding is in effect. If a bid is made within 10 minutes of the auction's scheduled end, the auction will automatically extend by 10 minutes. No further bids will be accepted after the final extension.
7. CONTRACT EXECUTION & EARNEST MONEY DEPOSIT
The winning bidder must:
- Execute the Auction Purchase Agreement immediately upon bid acceptance
- Deliver a non-refundable $5,000 Earnest Money Deposit within 24 hours of bid acceptance
Earnest Money Deposit must be paid by:
- Wire transfer, or
- Certified funds
The deposit shall be held by the designated title company and credited toward the purchase price at closing.
Failure to timely execute the agreement or deliver the deposit constitutes default and may result in forfeiture of bidding rights and damages as allowed by law.
8. CLOSING TIMELINE
Closing shall occur within thirty (30) calendar days of the auction date. Time is of the essence. Failure to close within the stated period, unless otherwise provided in a written agreement, shall constitute a contractual default and result in the forfeiture of your earnest deposit.
9. NON-CONTINGENT SALE / AS-IS CONDITION
