IMPORTANT NOTICE: These Terms are provided for marketing and informational purposes. In the event of any conflict or inconsistency, the fully executed Purchase Agreement, Auction Addendum, Escrow Agreement, and related transaction documents shall control.
These Real Estate Auction Terms and Conditions ("Terms") govern the offering and sale of the Property through the auction method of marketing. By registering, bidding, or executing a Purchase Agreement, Bidder agrees to be bound by these Terms and all related transaction documents.
- AUCTION METHOD
The Property is offered for sale using the auction method of marketing. The auction will be conducted online via AuctionNow.bid. Auctioneer may modify bidding procedures, increments, and timing as necessary. Auctioneer decisions regarding auction conduct and bidding shall be final.
- BIDDER REGISTRATION
All bidders must register and be approved prior to bidding. Auctioneer may require identification, proof of funds, financing approval, or other documentation. Auctioneer reserves the right to approve or reject any bidder. - BIDDER REGISTRATION DEPOSIT HOLD
A valid credit card is required to register, and a $2,500 authorization hold will be placed to verify funds. This is not a charge. The successful bidder must provide an Earnest Money Deposit equal to the greater of $5,000 or 5% of the Total Contract Price within the required timeframe. The $2,500 hold will be released for non-winning bidders and released or applied toward the deposit for the successful bidder.
- AUCTION TYPE
Minimum Bid Auction. Minimum Bid: $150,000. The Property shall sell to the highest bidder at or above the Minimum Bid.
- BUYER PREMIUM
A Buyer Premium of Ten Percent (10%) shall be added to the high bid to determine the Total Contract Price.
- CONTRACT PURCHASE PRICE
Total Contract Purchase Price equals High Bid plus Buyer Premium. Example: Bid: $100,000 + 10% Buyer Premium: $10,000 =$110,000
- EARNEST MONEY DEPOSIT
Earnest Money Deposit shall be the greater of $5,000 or 5% of the Total Contract Price and shall be deposited within 24 hours. Earnest Money shall be governed by the Purchase Agreement, Auction Addendum, and Escrow Agreement and is non-refundable except as expressly stated.
- PRE-SIGNED RELEASE AUTHORIZATION
Buyer shall execute a Pre-Signed Earnest Money Release Authorization. Escrow Agent is authorized to release funds without further Buyer consent in the event of default.
- BUYER DEFAULT
Default includes failure to sign documents, deposit earnest money, or close. Upon default, Earnest Money shall be forfeited as liquidated damages. Seller may pursue additional remedies. Broker shall be entitled to compensation as provided in the Listing Agreement.
- CLOSING
Closing shall occur on or before May 22, 2026. Time is of the essence. The transaction is not contingent upon financing unless expressly stated.
- PROPERTY CONDITION
The Property is sold AS-IS, WHERE-IS, WITH ALL FAULTS. Buyer is responsible for all inspections and due diligence prior to bidding.
- TITLE
Seller shall provide a marketable title subject to standard exceptions. Closing shall be conducted through the designated title company.
