These Real Estate Auction Terms and Conditions ("Terms") govern the offering and sale of real property through the auction method of marketing. By registering, bidding, or executing a Purchase Agreement, Bidder agrees to be bound by these Terms. These Terms are incorporated into the Purchase Agreement.
- AUCTION METHOD
The Property is offered for sale using the auction method of marketing. The auction may be conducted online. Auctioneer may modify bidding procedures as necessary to conduct the auction in a commercially reasonable manner. Auctioneer decisions regarding auction conduct shall be final. Seller and Auctioneer reserve the right to modify auction procedures prior to or during the auction. - BIDDER REGISTRATION
All bidders must register and be approved prior to bidding. Auctioneer may require government-issued identification, proof of funds, financing approval, earnest money preauthorization, and a signed bidder agreement. Auctioneer reserves the right to approve or reject any bidder at Auctioneer’s sole discretion. - BIDDER REGISTRATION DEPOSIT HOLD A valid credit card is required to register, and a $2,500 authorization hold will be placed to verify funds. This is not a charge. The successful bidder must provide an Earnest Money Deposit equal to the greater of $5,000 or 5% of the Total Contract Price within the required timeframe. The $2,500 hold will be released for non-winning bidders and released or applied toward the deposit for the successful bidder.
- BINDING BIDS
Each bid constitutes a legally binding and irrevocable offer to purchase the Property. Bids may not be withdrawn once placed. The Successful Bidder shall execute the Purchase Agreement and all required documents immediately following the auction or within the time specified by the Auctioneer. Failure to execute required documents shall constitute Buyer’s default. - AUCTION TYPE
Minimum Bid Auction. Minimum Bid: $80,000. The Property shall sell to the highest bidder at or above the Minimum Bid. Seller shall not reject a bid meeting the Minimum Bid. - BUYER PREMIUM
A Buyer Premium shall be added to the High Bid. Default Buyer Premium: Ten Percent (10%). The Buyer Premium shall be added to the High Bid to determine the Total Purchase Price. - CONTRACT PURCHASE PRICE
Total Contract Purchase Price equals High Bid plus Buyer Premium. Example: Bid: $100,000 + 10% Buyer Premium:$10,000 = $110,000 - EARNEST MONEY DEPOSIT
Successful Bidder shall deposit Earnest Money in the amount of $5,000 within the time specified in the Purchase Agreement. Earnest Money shall be governed by the Purchase Agreement, Purchase Addendum, Escrow, Non-Refundable Earnest Money Deposit Agreement, and Pre-Signed Earnest Money Release Authorization. Earnest Money shall be non-refundable except as expressly provided in the Escrow Agreement. - PRE-SIGNED RELEASE AUTHORIZATION
- Successful Bidder shall execute a Pre-Signed Earnest Money Release Authorization at the time of contract signing. Escrow Agent is authorized to release Earnest Money without further Buyer signature in the event of Buyer default.
- BUYER DEFAULT
Buyer default includes failure to execute the Purchase Agreement, failure to deposit Earnest Money, failure to close, or failure to perform contractual obligations. If Buyer defaults, Earnest Money shall be forfeited as liquidated damages. Escrow Agent may release Earnest Money pursuant to the Escrow Agreement. Seller may pursue additional legal remedies, and Broker shall be entitled to compensation as provided in the Listing Agreement. Seller remedies are cumulative and not exclusive. - CLOSING
Closing shall occur on or before May 22, 2026. Time is of the essence. Buyer shall be responsible for all financing arrangements. The transaction shall not be contingent upon financing unless expressly stated in writing. - PROPERTY CONDITION
The Property is sold AS-IS, WHERE-IS, WITH ALL FAULTS. Seller and Broker make no representations or warranties except as expressly stated in writing. Buyer is solely responsible for inspections and due diligence. Buyer acknowledges having had the opportunity to inspect the Property prior to bidding, including scheduled open houses. - TITLE
Seller shall provide a marketable title as defined in the Purchase Agreement. Title objections shall be handled pursuant to the Purchase Agreement. Closing shall be conducted through TRUE Title. - CLOSING COSTS
Unless otherwise stated in the Purchase Agreement, Buyer shall pay title insurance premiums, recording fees, closing fees, lender fees, and inspection costs. Seller shall pay deed preparation and transfer taxes if required by law. - POSSESSION
Possession shall be delivered at closing unless otherwise stated in writing. - PRE-AUCTION OFFERS
Seller reserves the right to accept a pre-auction offer. Seller may cancel or modify the auction at any time prior to contract execution. - POST-AUCTION OFFERS
Seller reserves the right to accept backup offers. Backup bidders may be required to submit Earnest Money. - BROKER DISCLOSURE
